Terms of Service

Welcome to FSBOHub ("FSBOHub," "Company," "we," "us," or "our"). By accessing or using the website and mobile platform at fsbohub.co (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
1. Platform Description and Role
FSBOHub is a technology platform and marketplace/directory that provides FSBO sellers with step-by-step guidance and connects them with vetted home service vendors, mortgage lenders, and buyer's real estate agents. FSBOHub is not a licensed real estate broker, does not provide real estate, legal, or financial advice, and does not facilitate brokerage activities or referral fee arrangements. Displaying agents or sharing consented vendor contact information does not constitute brokerage activity. Sellers should consult licensed professionals — including a licensed real estate attorney or a licensed realtor providing limited services — for contract review, disclosure preparation, and closing guidance.
2. Eligibility
You must be at least 18 years of age and a U.S. resident to use the Platform. By registering, you represent and warrant that you meet these requirements. The Platform is not directed to minors and we do not knowingly collect data from anyone under 18.
3. Seller Terms
FSBO Sellers may use the Platform free of charge. By registering as a seller, you agree to:
- Provide accurate and truthful information about yourself and your property.
- Not misrepresent the condition, status, or details of your property.
- Use the Platform only for legitimate FSBO home sale activity.
- Acknowledge that FSBOHub does not verify property information and is not responsible for the accuracy of your listing details.
- Understand that vendor contact information is provided solely for the purpose of obtaining home services and may not be used for any other purpose.
4. Vendor Terms (Home Service Providers)
By applying to and participating on the Platform as a vendor, you agree to:
- Provide accurate license numbers, license state, and insurance certificate information. Misrepresentation of credentials is grounds for immediate removal.
- Maintain a current and valid professional license and liability insurance for the duration of your Platform subscription.
- Contact sellers within 24 business hours of receiving a consented lead. Failure to do so may result in suspension.
- Only contact sellers who have submitted a consent-gated lead request through the Platform. Contacting sellers outside this system — including cold calls, unsolicited emails, or any outreach not initiated by a seller's explicit consent — is a material breach of these Terms and will result in immediate suspension.
- Maintain a vendor feedback score of 4.7 stars or higher to remain listed.
- Acknowledge that FSBOHub acts as a marketplace only and is not a party to any service agreement between you and a seller. Sellers contract directly with you.
5. Lender Terms (Mortgage Lenders)
By applying to and participating on the Platform as a lender, you agree to:
- Provide accurate NMLS license numbers and maintain a valid license for the duration of your Platform subscription.
- Not engage in unsolicited outreach to sellers. Lender contact information is displayed to sellers who actively choose to view it; sellers initiate all contact.
- Comply with all applicable federal and state lending laws, including RESPA, TILA, and state-specific mortgage licensing requirements.
- Acknowledge that FSBOHub is not a mortgage broker and does not endorse any particular lender or loan product.
6. Buyer's Agent Terms (Real Estate Agents)
By applying to and participating on the Platform as a buyer's agent, you agree to:
- Provide accurate license numbers and license state information. Misrepresentation of credentials is grounds for immediate removal.
- Maintain a current and valid real estate license for the duration of your subscription.
- Maintain a minimum average rating of 4.8 stars (based on verified seller reviews) to remain listed on the Platform.
- Buyer's agents have no outreach obligations to sellers. Agent profiles are displayed to sellers who have completed the "Plan Your Move" intake; sellers initiate all contact. FSBOHub does not direct agents to contact any seller.
- Acknowledge that FSBOHub is not a real estate broker, does not act as your broker of record, and does not facilitate referral fee arrangements. Any compensation arrangement is solely between you, your brokerage, and your clients.
- Comply with all applicable state real estate laws, NAR Code of Ethics (where applicable), and any state-specific advertising and solicitation rules.
7. Referral Program Terms
Active vendors in good standing may participate in the vendor referral program. Referral discounts are awarded based on the number of verified seller registrations attributed to a vendor's unique referral code within a contract year, as follows: 10% discount for 1–4 referrals, 20% for 5–9, 35% for 10–19, and 50% for 20 or more. Discounts activate after a vendor has maintained an active subscription for at least 6 months and reset annually on the vendor's contract anniversary date. FSBOHub reserves the right to modify or discontinue the referral program at any time with 30 days' written notice to participating vendors.
8. Ratings and Reviews
Only verified sellers — those who have completed both the initial FSBO intake form and the "Plan Your Move" intake form — may submit ratings and reviews for buyer's agents. This cross-verification requirement exists to ensure the integrity of the rating system. By submitting a review, you represent that your review is truthful, based on your genuine experience, and not submitted on behalf of another person. FSBOHub reserves the right to remove reviews that appear fraudulent, coerced, or in violation of these Terms. Agents may not offer incentives in exchange for reviews.
9. Payment Terms
Vendor, lender, and agent subscriptions are processed through Stripe. By subscribing, you authorize FSBOHub to charge your payment method on a recurring basis according to the subscription tier you selected. Subscriptions auto-renew annually unless cancelled at least 30 days before the renewal date. FSBOHub does not store credit card numbers or CVV codes. All payment data is handled directly by Stripe in accordance with PCI-DSS standards. Refund requests are evaluated on a case-by-case basis; contact [email protected] within 30 days of a charge to request a review.
10. Prohibited Conduct
You agree not to:
- Submit false, misleading, or fraudulent information in any application or profile.
- Submit fake reviews or ratings, or solicit others to do so.
- Misrepresent your professional credentials, licenses, or insurance status.
- Circumvent the consent-gated lead system to contact sellers without their explicit consent.
- Use the Platform to send spam, unsolicited commercial messages, or bulk communications.
- Scrape, harvest, or collect user data from the Platform by automated means.
- Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
- Use the Platform for any unlawful purpose or in violation of any applicable law.
11. Intellectual Property
All Platform content, including text, graphics, logos, and software, is owned by or licensed to FSBOHub and is protected by applicable intellectual property laws. By submitting content to the Platform (including business descriptions, profile information, and reviews), you grant FSBOHub a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content in connection with operating the Platform. You retain ownership of your submitted content.
12. Termination and Suspension
FSBOHub reserves the right to suspend or terminate any account, at our sole discretion, for violation of these Terms, fraudulent activity, failure to maintain required credentials, or any conduct that we determine to be harmful to users or the Platform. Vendors suspended for failure to contact sellers within 24 business hours will receive written notice and an opportunity to respond before permanent removal. Termination does not entitle you to a refund of any prepaid subscription fees.
13. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FSBOHUB DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
FSBOHUB DOES NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY VENDOR, LENDER, OR AGENT LISTED ON THE PLATFORM. FSBOHUB IS NOT A PARTY TO ANY AGREEMENT BETWEEN A SELLER AND A VENDOR, LENDER, OR AGENT. ALL TRANSACTIONS AND SERVICE AGREEMENTS ARE SOLELY BETWEEN THE RELEVANT PARTIES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FSBOHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF FSBOHUB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FSBOHUB'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FSBOHUB IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
15. Indemnification
You agree to indemnify, defend, and hold harmless FSBOHub and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform, your violation of these Terms, your violation of any applicable law, or your infringement of any third-party rights.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of [Oklahoma or Delaware, once entity formed], without regard to its conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. You waive any right to participate in a class action lawsuit or class-wide arbitration. [Note: Consult your attorney regarding the enforceability of this clause in your jurisdiction.]
17. Changes to These Terms
FSBOHub may update these Terms at any time. Material changes will be communicated by posting the updated Terms on the Platform with a new "Last Updated" date and, where required, by email or in-app notice. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
18. Entire Agreement and Severability
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FSBOHub regarding your use of the Platform. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
